Terms of use

These Terms of Service (hereinafter referred to as "these Terms") set forth the terms and conditions for the use of the services (hereinafter referred to as "the Service") provided on the website "AARUSHI Shop" (https://www.aarushi.shop) (hereinafter referred to as "the Site"), operated by M-Gene, Ltd. (hereinafter referred to as "the Company"). Customers who use the Service (hereinafter referred to as "the Customer" or "You") shall use the Service after agreeing to these Terms.

Article 1 (Application)

  1. These Terms shall apply to all relationships concerning the use of the Service between the Customer and the Company.

  2. Rules concerning the use of the Service that the Company posts on the Site shall constitute a part of these Terms.

  3. In the event of any conflict between the provisions of these Terms and the rules mentioned in the preceding paragraph or any other descriptions of the Service outside of these Terms, the provisions of these Terms shall prevail.

Article 2 (Member Registration)

  1. A Customer who wishes to use the Service may apply for member registration by agreeing to these Terms and providing certain information as specified by the Company (hereinafter referred to as "Registration Information") in the manner prescribed by the Company.

  2. The Company shall, in accordance with its own criteria, determine the eligibility of the Customer who has applied for registration pursuant to the preceding paragraph, and if the Company approves the registration, it shall notify the Customer to that effect. Member registration shall be deemed completed upon this notification.

  3. The Customer shall be responsible for the proper management of their user ID and password for the Service. Under no circumstances may the Customer assign, lend, or share their user ID and password with a third party.

  4. If there is any change to the Registration Information, the Customer shall promptly follow the procedure for changing the Registration Information in the manner prescribed by the Company.

Article 3 (Sales Agreement)

  1. In the Service, a sales agreement between the Customer and the Company shall be deemed to have been concluded at the time when an email from the Company confirming acceptance of a purchase offer from the Customer reaches the Customer.

  2. The Company may cancel the sales agreement mentioned in the preceding paragraph without prior notice to the Customer if the Customer falls under any of the following circumstances: (1) The Customer has violated these Terms. (2) Delivery of the product cannot be completed due to an unknown address or a prolonged absence. (3) In any other case where the Company deems that the relationship of trust between the Company and the Customer has been undermined.

Article 4 (Payment) The Customer shall pay the purchase price of the product by the methods specified by the Company (credit card payment, bank transfer) by the deadline separately stipulated by the Company. Detailed terms regarding payment are as set forth on the "Notation based on the Act on Specified Commercial Transactions" page of the Site.

Article 5 (Delivery of Goods and Transfer of Ownership)

  1. Delivery of goods shall be made by a delivery carrier designated by the Company to the delivery address specified by the Customer.

  2. Ownership of the goods shall be transferred to the Customer when the Company hands over the goods to the delivery carrier.

Article 6 (Returns, Exchanges, and Cancellations) The terms and conditions concerning the return, exchange, and cancellation of products are as set forth on the "Notation based on the Act on Specified Commercial Transactions" page of the Site. The Customer shall be sure to check and agree to these provisions before ordering products.

Article 7 (Prohibited Acts) In using the Service, the Customer must not engage in any of the following acts:

  1. Acts that violate laws or public order and morals.

  2. Acts related to criminal activity.

  3. Acts that destroy or interfere with the functions of the Company's servers or network.

  4. Acts that may interfere with the operation of the Company's services.

  5. Acts of collecting or accumulating personal information about other Customers.

  6. Acts of engaging in or attempting unauthorized access.

  7. Acts of impersonating another Customer.

  8. Acts of directly or indirectly providing benefits to anti-social forces in connection with the Company's services.

  9. Acts that infringe upon the intellectual property rights, likeness rights, privacy, honor, or other rights or interests of the Company, other Customers, or other third parties.

  10. Acts of purchasing products through the Service for the purpose of resale, re-selling, or other for-profit activities.

  11. Any other acts that the Company deems inappropriate.

Article 8 (Suspension of the Service, etc.)

  1. The Company may suspend or interrupt all or part of the Service without prior notice to the Customer if it determines that any of the following reasons exist: (1) When performing maintenance, inspection, or updates of the computer systems related to the Service. (2) When the provision of the Service becomes difficult due to force majeure such as an earthquake, lightning, fire, power outage, or other natural disasters. (3) When computers or communication lines stop due to an accident. (4) In any other case where the Company deems that the provision of the Service is difficult.

  2. The Company shall not be liable for any disadvantage or damage suffered by the Customer or any third party due to the suspension or interruption of the provision of the Service.

Article 9 (Intellectual Property Rights) All copyrights, trademarks, and other intellectual property rights related to the Site and the Service belong to the Company or the rights holders who have licensed their use to the Company. The Customer may not reproduce, assign, lend, translate, modify, reprint, publicly transmit, distribute, publish, or use for business purposes any of these without permission.

Article 10 (Handling of Personal Information) The Company shall handle the Customer's personal information acquired through the use of the Service appropriately in accordance with the Company's "Privacy Policy." In using the Service, the Customer shall confirm the contents of said Privacy Policy and agree to it.

Article 11 (Modification of Terms) The Company may change these Terms at any time without notifying the Customer if it deems it necessary. If the Customer begins using the Service after the changes to these Terms have been made, the Customer shall be deemed to have agreed to the modified Terms.

Article 12 (Governing Law and Jurisdiction)

  1. The interpretation of these Terms shall be governed by the laws of Japan.

  2. In the event of a dispute concerning the Service, the Tokyo District Court, or the court having jurisdiction over the location of the Company's head office, shall be the exclusive court of first instance with agreed jurisdiction.
